A Town Clerk Pleads Guilty to Theft & Misconduct Gets Jail




The former Town of Dale clerk was found guilty Friday of theft and misconduct in office for using municipal credit cards for personal purposes.

Marcia A. Kelly, 68, pleaded no contest in Outagamie County Court to five counts of misconduct in public office and three theft counts as part of a plea agreement. 

Kelly agreed to repay more than $35,000 to the town.

Prosecutors dismissed 25 additional charges.

Kelly and Erica R. Siewert, the former town treasurer, were each charged on June 21 after a town audit revealed their inappropriate use of town credit cards.

Siewert was sentenced in October to 13 months on probation. 

She repaid the town before she was sentenced.

Deputy District Attorney Melinda Tempelis said she’ll recommend a probation sentence for Kelly to include nine months to a year of jail time.

Of Kelly’s eight convictions, seven were felony offenses.

Kelly’s use of town credit cards included hotel stays in Illinois and Wisconsin and a casino visit. She used town funds to purchase gift cards and pay phone bills, the criminal complaint says.

When Kelly prepared monthly financial statements for the town board, she didn't include checks she was writing to cover the credit cards.

Judge Nancy Krueger ordered a pre-sentence investigation.

Kelly will return to court on June 27 for sentencing.

A former Town of Dale clerk was sentenced to five months in jail, with work and childcare release, and three years of probation Thursday after she was found guilty of charging more than $35,000 to municipal credit cards, according to the Appleton Post-Crescent.

Marcia A. Kelly, 68, received the sentence in Outagamie County Circuit Court as part of a plea agreement in which she pleaded guilty to counts of misconduct in public office and three theft counts.

Kelly also has paid $35,369 in restitution.
