Manhattan Drops Lawsuit Against Elwood

Mayor James Doyle says that since Northpoint's plans are back at "square one," there's no need to continue the lawsuit at this time.

MANHATTAN, IL - The village of Manhattan has dropped its lawsuit against the village of Elwood over the once proposed Northpoint development. Mayor James Doyle wrote on the village website Wednesday that the goal in filing the lawsuit back in March was to ensure that the Northpoint project would go back to "square one," since Manhattan was not involved in the planning stage of the proposal.

Last week, Northpoint officially withdrew its application for Compass Business Park and the recommendation once issued by the Elwood planning commission expired.

"Giving these developments, continuing the case at this point would have been an unnecessary financial burden on the taxpayers and would have resulted in the same outcome as today," Doyle wrote, noting that the lawsuit was voluntarily dismissed without prejudice, meaning the village has the ability to refile it in the future.

Northpoint's original plan was to develop 2,300 acres of land in the undeveloped areas of southern Will County. In the suit, Manhattan claimed Elwood violated a boundary agreement by not including them in the planning stage.
