Cop Accused Of Sex Assault To Be Reinstated

Niles will pay the police officer, who was accused of assaulting a woman in early 2010, about 58 weeks of back pay; he forfeited a year of pay. He's on 'last chance' status for a year.

 

 

The Village of Niles has signed a legal agreement with who was accused of sexually assaulting a woman in Niles when he was off-duty in January 2010.

The village will reinstate Markadas, who has not been on the job in the two and a half years since then, in employment as a police officer, per the settlement agreement, which Patch obtained Thursday under the Freedom of Information Act.

An that the village had to pay Markadas 21 months of back pay and benefits; however, the village decided to appeal that ruling, and the agreement calls for paying Markadas just under 14 months' worth of back pay and benefits.

Specifically, it says the village and Markadas agree that he is/was suspended without pay from May 26, 2010 (the date the village terminated his employment) to May 25, 2011, a one-year period. 

However, the agreement binds the village to give him back pay from May 25, 2011 to the date of the agreement--July 13 2012, which is about one year and seven weeks. The village must also reimburse Markadas for health care premiums he paid out of his pocket during that period to maintain the health care he had while employed.

Village attorney Joseph Annunzio said Thursday he was not ready to comment on the agreement at this time.

In the January 2010 incident, a waitress working in a Niles bar said Markadas, who was off duty at the time, sexually assaulted her in the bar's basement. She reported it to police and filed civil charges, but not criminal charges, according to the Journal and Topics. 

The settlement agreement also says Markadas will be on "last chance" status for a year, and that if the village proves he engaged in conduct similar to the sexual assault, that will be grounds for immediate firing with no appeal.
