Village Makes Decision In Sex Assault Case
A court had ordered it to reinstate a police officer who was accused of sexually assaulting a waitress.

The village of Niles has decided to fight a court order that would reinstate Fotis Markadas to his job as a police officer.
A waitress had accused Markadas of sexually assaulting her in January 2010, She told police that while he was off-duty, he assaulted her at the bar where she worked. She did not file criminal charges.

The Village of Niles, which is the employer of Niles Police Department officers and staff, suspended Markadas after the incident.

An arbitrator ruled in April that the village must reinstate Fotis and provide him 21 months of back pay.
"The village has decided to appeal the arbitrator's decision in (Cook County) circuit court," said Joe Annunzio, Niles' village attorney.
He did not comment on the matter of whether the village should have to pay the 21 months of back pay.
