Prosecutors said the woman admitted that she had been drinking alcohol the night of the encounter, but did not give Podkanowicz her consent to have sex.

The assistant public defender said that Podkanowicz had no prior criminal background.

Bail was set at $30,000. The judge ordered Podkanowicz not to have any contact with the woman.

His next court date is August 31.
