Downstate Man Does 5 Shots at Orland Dave and Buster's, Throws Up, Tries To Sleep It Off In Parking Lot With Young Daughter In Back Seat: Cops
The Arcola man told officers his 6-year-old daughter was OK with him sleeping in a parking lot, police said.
An Arcola man downed five shots at the Orland Park Dave & Buster’s, drove off, stopped to throw up, and then decided to get some sleep in a parking lot with his 6-year-old daughter in the back seat, police said.
Andrew Spear, 28, was charged with endangering the life of a child and driving under the influence after police found him in a parking lot up the road from the Dave & Buster’s.
Officers were sent to investigate a report of a man “vomiting in the parking lot with a small child in the back seat,” police said, and also had a call from a woman who “saw the driver do several shots before leaving Dave and Buster’s with a small child in the back seat.”

An officer said that as he approached Spear’s car, he “noticed vomit on the pavement directly below the driver side door,” according to a police report.
When Spear got out of the car to have a word with the officer, he was “unable to balance as we spoke, his words were slurred, and he seemed emotionally upset,” police said.

“Andrew stated that he was at Dave & Buster’s earlier for a party,” police said. “He stated that he had five shots of Fireball and two sips of beer in a four hour period. He stated that he left Dave and Buster’s with his daughter … and started driving home.”
Spear didn’t make much progress on his trip to Arcola, as “he knew he couldn’t drive so he stopped in the parking lot,” police said.
“Andrew stated that his intentions are to spend the night in the parking lot to sleep because he is unable to drive,” police said. “When I asked if he intended to sleep in the parking lot with his daughter in the car, he stated that (she) said it was OK.”
During a sobriety test in which Spear was supposed to stand on one foot, he “fell to the ground and appeared to be in extreme pain,” police said. “Andrew was asked if he would like an ambulance and Andrew stated that he did.”
But then “Andrew began breathing very fast and stated that he could not feel his legs,” police said. “At that time, Andrew was placed under arrest for driving under the influence and for endangering the life of a child.”
Spear was taken to Palos Community Hospital and Dave & Buster’s was slapped with a municipal violation, police said.
