OSWEGO, IL — A DuPage County judge denied a state motion to deny bond to an Oswego man who is accused of being in possession of a weapon altered to fire as a fully automatic machine gun.

Caleb Davis, of the 400 block of Treasure Drive, is charged with two counts of unlawful possession of a weapon, loaded machine gun on person and possession in passenger compartment of a motor vehicle. DuPage County Judge Brian Telander set the 18-year-old's bond Thursday at $25,000, with 10 percent to apply.

The case stems from an incident around 9 p.m. June 29, when Naperville police officers approached a car that drove to and parked in a dimly lit area of a parking lot in the 2700 block of West 75th Street. Police say they approached the car, driven by Davis, and saw the butt of a firearm protruding from under the feet of the front seat passenger, according to a news release.

When police searched the car, they found a loaded 9mm Glock handgun with one bullet in the chamber and 34 bullets in the magazine that was kept in the center console. Officials said the Glock had been modified to fire as a fully automatic machine gun.

The passenger in the car had a valid Firearm Owners Identification Card and a valid Concealed Carry License.

Davis was taken into custody, but officials did not say if they arrested or charged the passenger, who was not named in the release.

"It is alleged that Mr. Davis, who did not possess either a FOID Card or a CCL, was illegally in possession of an illegally modified weapon," DuPage County State's Attorney Robert Berlin said in a statement. "I commend the Naperville Police Department for their heads-up work in this case that took a very dangerous weapon off the streets."

Davis's next court appearance, for arraignment, is scheduled for Aug. 21.
