Shorewood Shoots Back at Sled Suit Family

The isn't rolling over in the face of a Plainfield family suing over a supposed sledding mishap in from nearly four years ago.

Attorneys for the village have a counterclaim alleging negligence on the part of the Plainfield mother whose daughter allegedly sledded into a sign at the bottom of a hill.

The counterclaim accuses mother Kristy Mahon of failing to properly supervise her daughter Jessica Mahon, and of failing to exercise reasonable care and control over the girl.

The counterclaim notes that the village denies liability, but in the event it loses the case wants the Mahons to hand back their judgment along with "any other relief this court may deem necessary and appropriate," plus something to make up for Kristy Mahon's alleged negligence.

Attorneys for the village filed the counterclaim in May, but the case remains mired in the court system. The next return date is scheduled for March.

Kristy Mahon and her husband, Jon Mahon, filed the lawsuit in January 2009.

The Mahons claim their daughter sustained "serious personal and pecuniary injuries" when she crashed into a sign posted at the bottom of the Four Seasons Park sled hill.

The lawsuit gives no information on the nature or extent of Jessica Mahon's alleged personal or pecuniary injuries. The suit does say she "struck a sign" while she was "lawfully sledding down a hill."

The village's counterclaim alleges that "at all times relevant, Jessica Mahon was in the care and custody of her mother" and that "Kristy Mahon was negligent" in a variety of ways.

The Mahons are seeking $50,000 from Shorewood, plus the the cost of their legal expenses.
