A man spit blood and saliva at two ambulance workers outside the Tinley Park Kmart where he had been picked up for a retail theft, prosecutors said in court Tuesday.

Donald Horn, 38, appeared before Cook County Judge Peter Felice on charges of criminal damage to a state supported property, aggravated battery to a peace officer, and two counts of aggravated battery to an emergency medical technician.

Tinley Park police were called to the store at 16300 S. Harlem Ave. on Aug. 29 for a retail theft.

According to the charges, the altercation began when Horn was told to stop resisting attempts to place him into an ambulance after he broke out the passenger side and driver side windows of a state-supported vehicle.

Prosecutors said Horn spit blood and saliva at the two EMTs, who sought medical treatment afterward.

Horn was taken to Palos Community Hospital in Palos Heights. He appeared in court Tuesday for a hearing in Bridgeview.

The assistant public defender told the judge Horn is on disability for “numerous medical conditions.” She objected when the prosecutor asked the judge for an order requesting Horn’s medical treatment records from the hospital.

Judge Felice set bail at $75,000. Horn is due back in court on Sept. 24.
