Collapsing Chair Sent Patron Tumbling to Floor: LAWSUIT

A woman is suing a Westmont restaurant after the chair she was sitting in collapsed underneath her, the lawsuit alleges.

Cheryl Kakuska filed a lawsuit in Dupage County Circuit Court against the Neat Kitchen and Bar at 246 North Cass Ave. in Westmont.

According to the complaint, Kakuska was dining at the restaurant on Dec. 6, 2014, when the chair she was sitting on collapsed.

The lawsuit maintains that it was the duty of the Neat Kitchen and Bar to provide safe and proper chairs and stools for its patrons.

As a result of the defective seating, Kakuska says that she fell and severely injured herself causing her to miss work. She also suffered monetary and mental anguish as a result of her injuries, the complaint said.

Kakuska is asking for damages in excess of $50,000.
