Man Who Attacked Ex Released Early To Live In Wheaton: Report

Joseph McHale was found not guilty by reason of insanity after he attacked his ex-girlfriend in Glen Ellyn, authorities say.

WHEATON, IL --- A Wheaton man who faced a more than 50-year sentence in a mental health facility for allegedly sexually assaulting his ex-girlfriend has been released early. Joseph McHale, 31, has been held at Elgin Medical Health Center since after he pleaded insanity on charges that he forced his way into the home of a 23-year-old woman and attacked and sexually assaulted her.

In July, McHale's lawyers filed for McHale to be conditionally released and that request was granted on Tuesday after a DuPage County judge ruled that his mental health had been stable enough to permit it, according to Daily Herald.

McHale will live with his parents in Wheaton as he works to complete an outpatient treatment plan arranged by the Illinois Department of Human Services. Daily Herald reports that more than a dozen outpatient centers declined to treat McHale because of his "sex offender status."
