What Happens After I Receive a D.U.I.? New Visions Court Counseling receives this question frequently. Below are steps that take place.

What are the levels of treatment and how many hours are required?
Upon receiving a D.U.I. one must undergo an evaluation. The purpose of this evaluation is to determine how many hours of treatment one must go through in order to qualify to.receive their driving privileges back.
There are currently four categories of treatment:

1) Level I (Remedial/Minimal Risk) - mandated 10 hours of risk education classes
2) Level II M (Moderate Risk) - mandated 12 hours of treatment along with 10 hours of risk education (Level I)

3) Level II S (Significant Risk) - mandated 20 hours of treatment along with 10 hours of risk education (Level 1) and 6 months of continuing care
4) Level III (High Risk) - mandated 75 hours of treatment classes along with 12 months of continuing care
Where do I go to get this evaluation completed?
This depends on what county the D.U.I was received in. If the D.U.I. was received in Dupage, Lake or Cook counties, one must undergo the evaluation at a designated spot. In Dupage County, all evaluations are done by the Adult Probation Department. In Cook County, all evaluations are done by Central States Institute on Addiction. In Lake County, all evaluations are done by NICASA.
If a person received a D.U.I. outside of any these counties, they must undergo the D.U.I evaluation at an agency that provides this service. New Visions is one of the agencies that provides D.U.I.evaluations along with other types of evaluations for the courts.
After an evaluation is completed, what do I do next?
Each county has a list of approved agencies which can provide classes to fulfill the court mandated treatment hours needed. New Visions is an approved agency for Dupage county. In addition, we also have the ability to serves other counties.
What happens if I refuse chemical testing?
If one refuses a chemical testing and it is their first D.U.I. offense, their license will be suspended for twelve months. If they refuse chemical testing and have a prior D.U.I. offense their license will be suspended for thirty-six months.
What happens if I receive a Suspension?
Suspensions can be challenged via a court hearing. This challenge should be consulted and advised with an attorney.
1st time offenders may be eligible for driving privileges during the suspension with the installation of a BAIID (Breath Alcohol Ignition Interlock Device)
What is the difference between a suspension and a revocation?
A suspension is a temporarily loss of your license for a set period of time. Once the suspension is over, driving privileges are automatically re-instated after paying a reinstatement fee.
A conviction can result in a revocation of your driver’s license. A revocation can be forever. The only way reinstatement of driving privileges is allowed is applying through the Secretary of State through the administrative hearing process.
