Attorney Steve Kirsh Examines Law Barring Non-Indiana Attorneys and Adoption Agencies from Advertising

The Indiana General Assembly has taken a hard line on attorneys and adoption agencies who are not licensed in Indiana and who advertise in the state. Prior to July 1, 2017, Indiana Law only bars non-Indiana attorneys and adoption agencies from advertising in telephone directories in Indiana.
“As of July 1, 2017, Indiana Code § 35-46-1-21 bars attorneys and agencies who are not licensed in Indiana from advertising in any way in Indiana when it defined ‘advertisement’ to mean ‘any communication by any medium within the borders of Indiana,’ including print advertisements, digital advertisements, radio, television, and outdoor advertising signs,” said Steve Kirsh, a founding attorney at Kirsh & Kirsh, P.C who has over thirty-five years’ experience as an adoption attorney.
Furthermore, the General Assembly increased the penalty for violating Indiana Code § 35-46-1-21 from a misdemeanor to a felony. Indiana Code § 35-46-1-22 remains unchanged and, among other things, criminalizes the providing of “adoption services” by non-Indiana attorneys and adoption agencies to a biological parent in Indiana.
