The Health Care Law Loses By Winning

Supporters of the health care overhaul should actually hope for a loss at the Supreme Court level.

The US Supreme Court has begun reviewing the overhaul of national health care laws and will hear three days of oral arguments.

I'm not the legal side of this blog, so I am veering away from THAT analysis.

But I do have finely-honed political skills.

This poll indicates that supporters of the health care law would actually lose if the Supreme Court upholds the law.

More people oppose than support the law. Campaign strategists will also seize upon the fact that 30 percent of the respondents strongly oppose the law while only 16 percent strongly approve. These are people whose votes can be influenced on this one issue.

Drill down further, and you'll find that 37 percent of the biggest voting bloc--seniors--strongly oppose the law while 20 percent strongly support it.

If SCOTUS upholds the law, the issue of repealing it becomes a major campaign wedge issue. If it is struck down, members of Congress and the President get to hit the "reset" button on the issue before the next election. They can, perhaps, highlight their support of the most popular aspects of the law while "forgetting" about the unpopular stuff.
