He says the girl's dad threatened to kill him in front of his children.

A man recently arrested for with a child told West Des Moines Police that he wanted assault charges filed against the alleged victim’s father, who he claimed had beat him up.

Byron Alberta Martinez, 29, was charged July 6 and held at the Dallas County Jail after he allegedly fondled the breasts of the 11-year-old daughter of a person with whom he had been staying.

Martinez reportedly said the girl was the aggressor and that he was about to push her away when her stepmother walked past the bathroom, where he was cleaning a fish tank, and interrupted the encounter. She called police and Martinez was charged.

According to a report on file at the West Des Moines Police Department, Martinez alleged that about 40 minutes later, the girl’s father “began punching him in the face and threatening to kill him in front of his 3- and 4-year-old children.”

He told police he wanted the girl’s father arrested on assault charges.
