Notice of Public Comment Period and Public Hearing on a FEDOOP Construction Permit

The Louisville Metro Air Pollution Control District (District) proposes to issue a FEDOOP construction permit to Brown-Forman Distillery (distillery), 2921 Dixie Highway, in accordance with Regulation 2.17. The 30-day public comment period starts on August 13, 2021, and ends on September 13, 2021. Written comments will be accepted at airpermits @ louisvilleky.gov until midnight or at the District office until 5:00 p.m. on September 13, 2021.  Oral statements will be accepted at a virtual public hearing to be held on September 14, 2021, from 6:00 p.m. to 7:00 p.m. Instructions for joining the public hearing will be posted on the following website: https://louisvilleky.gov/government/air-pollution-control-district.

Drafts of the permit and summary are available at the District office, 701 West Ormsby Avenue, Suite 303, Louisville between 8:00 a.m. and 5:00 p.m., Monday through Friday, by calling Matt King at (502) 574-6000 or emailing airpermits @ louisvilleky.gov or at the following website: http://www.louisvilleky.gov/APCD/docket. Copies of the application are available upon request.

1.    What is the purpose of this permit? The purpose of this permit is an expansion that will increase the distillery's maximum potential production rate of distilled spirits from to 11,914,500 original proof gallons (OPG) per year to 26,256,000 OPG per year. Brown-Forman will install a granary, fermentation vessels, process vessels, storage tanks, by-products process, and a boiler.

2.    Will this permit increase air pollution? This permit will potentially increase VOC emissions by 51.16 tons per year and PM10 emissions by 48.67.

3.    Does this facility have a history of non-compliance? This facility has not had any non-compliance issues since the issuance of the operating permit O-0244-18-F issued on 11/19/2018.

4.    Where can I find out more? Additional information, including emissions units, potential and past actual emissions, applicable rules, and air pollution control equipment, are summarized in the Statement of Basis. The Draft Permit details the application of these rules to the emissions units and air pollution control equipment and includes the monitoring, recordkeeping, and reporting that the District deems is necessary to demonstrate compliance.
