Louisville Councilwoman Purvis And President James Applaud Today Action By Codes And Regulations And LMPD For Dino To Vacate Premises

Louisville – Councilwoman Donna Purvis (D-5) and President David James (D-6) applaud the action by Code Enforcement and LMPD for Dino’s at 2601 W Broadway to vacate the premises. The action follows recent findings that determined Dino’s as a public nuisance

Code Enforcement Officers served the vacate order today.

“This is a significant victory for the community because of the problems this establishment could not control,” said Councilwoman Purvis. “Residents in the area deserve to be safe and with this action I can see a safe environment for the people who have long suffered because of how this business operated.”

“We expect businesses to have a positive impact on the areas they serve,” said President James. “Every business owner has a responsibility to be a good neighbor and control problems. I hope this action sends the message that if your businesses becomes a nuisance, we will take action to stop it.”

The order follows an initial hearing after a Notice of Public Nuisance Violation was sent to Dino’s owners on April 8, 2020 deeming the property a Public Nuisance as authorized by Chapter 156.057 of the Louisville Metro Code of Ordinances.

An appeal was filed, and a hearing was held on July 24, 2020 wherein the Code Board reviewed the appeal. It was denied and a Final Order was issued on July 24, 2020 reflecting the Board’s findings.

Additional Public Nuisance qualifying events pursuant to Chapter 156.057 have occurred since July 24, 2020.

On July 25, 2020 at approx. 1700hrs, the following activities constituting a Public Nuisance occurred on your property: KRS- 508.030, Assault – 4th Degree (no visible injury)- Case number 80-20-044180

On August 8, 2020 at approx. 1230hrs, the following activities constituting a Public Nuisance occurred on your property: KRS- 508.030, Assault – 4th Degree (minor injury)- Case number 80-20-047242
KRS- 218.1430, Possession of Synthetic Drugs 1st Offense- Case number 80-20-047242

According to the order: “Due to the above events and the non-abatement of the public nuisance, a civil penalty is now being assessed for $400.00. In addition to the civil penalty, you must vacate this property immediately.”

The owners of Dino’s, SHM 2601 LLC, have the right to appeal the order to the Metro Code Enforcement Board,
