Police Say Man Tried To Rape Girl While Wife Was In Labor: Report

MONTGOMERY VILLAGE, MD — A Montgomery Village man is behind bars for trying to rape a 12-year-old girl while his wife was pregnant with their unborn child, according to charging documents obtained by WJLA.

Luis Perez-Giron, 28, has been charged with two counts of third-degree sexual offense stemming from two separate incidents.

According to charging documents, the first incident took place at Perez-Giron's apartment earlier this year. WJLA reports that the victim's family was over at Perez-Giron's home for a friendly get-together. While the adults were busy chatting, the 12-year-old victim, her two-year-old sister, and Perez-Giron's five-year-old son went to the master bedroom to listen to music.

When Perez-Giron walked into his room, he sat down on the bed and kissed the 12-year-old girl on her neck, police allege in court documents. He then reportedly began touching her breasts and genitals.

Perez-Giron allegedly told the girl to keep quiet about the assault, threatening to hurt her family if she told her mother what happened.

When Perez-Giron's wife went into labor on May 8, she called the victim's mother to ask if they could take care of their 5-year-old son for a little while. The mother agreed.

According to WJLA, Perez-Giron came to the victim's home while his wife was in the hospital. The scared 12-year-old girl was home alone at the time, and locked herself in the bathroom.

After some time, the girl came out of the bathroom. But Perez-Giron was still there, the news outlet reports. He then allegedly sat the victim down on the couch and touched her breasts. Based on the court filing, the 28-year-old man then tried to take off the girl's pants. The victim managed to keep her pants on and run back to the bathroom.

A little while later, the girl left the bathroom again, but didn't see Perez-Giron. According to WJLA, the father-to-be was hiding in a closet. He then reportedly jumped out of the closet and pushed the girl to the floor.

Perez-Giron proceeded to drag the girl to the couch, rip off her shirt, and touch her breasts. Charging documents also allege that he tried to take off the victim's pants, but was only able to pull them halfway down her legs. Perez-Giron later told the girl to keep the assault a secret. He also reportedly told the girl that he was going to rape her when she turned 13.

Montgomery County Police have since arrested and charged Perez-Giron for the assaults. He is scheduled to appear in court on Sept. 6.
