Drunken Cape Cod Man Tased After Leaving Restaurant: Police

The restaurant called police when the man allegedly refused a ride home and drove away.

YARMOUTH, MA – A Cape Cod man was arrested Monday morning after allegedly driving home drunk from a Yarmouthport restaurant. Officers responded to Oliver's on Rt. 6A around 1 a.m. after employees at the restaurant told police a drunk man had refused a safe ride home, became violent and drove away.

Police stopped 29-year-old Patrick Leary, of Dennis, on South Yarmouth Road based on a license plate number and description of the driver provided by the employees. Leary was "physically and verbally combative" and refused to leave his car, police said.

Officers used a taser on Leary and placed him under arrest. He allegedly spit at and was verbally abusive toward officers on the way to the police station.

Leary was charged with OUI liquor (second offense), negligent operation of a motor vehicle, disorderly conduct, resisting arrest and possession of an open container of alcohol in a motor vehicle. He was arraigned Monday in Barnstable District Court.
