Guilty Verdict For Cape Cod Man Who Broke Bottle Over Husband's Head

A Provincetown man was found guilty on aggravated assault and battery charges in addition to witness intimidation and withholding evidence.

PROVINCETOWN, MA — A Barnstable Superior Court judge found a Provincetown man guilty on multiple charges relating to a September assault when he broke a bottle over his husband's head, the Cape and Islands District Attorney announced.

Joseph I. Amato, of Provincetown, was found guilty of aggravated assault and battery with a dangerous weapon, assault and battery on a family member, two counts of witness intimidation and withholding evidence from a criminal proceeding.

Amato was acquitted on one related charge.

The indictments stem from an "unprovoked attack" on Sept. 30 in Provincetown where the Amato struck his husband on the head with a bottle causing serious injury, officials said.

While awaiting trial, Amato made multiple phone calls from the jail to his husband, instructing him to destroy evidence and attempting to intimidate him so that he would not cooperate with the Commonwealth’s case, officials said.

Amato is held without bail. A sentencing date is set for Nov. 14.
