City Settles Decades-Long Dispute With Beverly Port Marina

A decades-long legal battle over public access to the rest of the waterfront area is coming to an end.

BEVERLY, MA — A decades long dispute locked in courts between the city and the Beverly Port Marina about a public walkway is finally coming to an end. The city and the Beverly Port Marina have agreed to settle, according to the Salem News and Wicked Local.

The owner of Beverly Port Marina has agreed that it will not challenge the development that the city envisions for the Water Street site, for at least three years.

The city has agreed to dismiss its appeal of a 2012 Department of Environmental Protection decision that replaced public access across the Beverly Port Marina property — from Water Street to the waterfront — with the public access through the 1 Water St. site, if the public access to the waterfront from that location is provided.

The settlement helps set the stage for the development of 1 Water St.

“The settlement agreement ultimately advances the city’s goal of activating the waterfront and creating an inviting destination for the public to enjoy, which has been a goal of the city since it bought the property in 1995,” Mayor Cahill said in an email statement to Wicked Local.
