Ousted Firefighter Files New Claim Against Brookline: Report

Gerald Alston was fired by the Board of Selectmen earlier this month.

BROOKLINE, MA – A former Brookline firefighter who was terminated earlier this month has filed a new complaint against the town.

Gerald Alston, fired during a Board of Selectmen meeting on October 5, claimed in court documents that he has been the target of retaliation since reporting that a superior used a racial slur in a voicemail more than six years ago.

According to the Boston Globe, Alston filed a lawsuit against the town in federal court, which was dismissed in September. The judge allowed Alston to file a new complaint, which he submitted Oct. 21, the Globe reported.

The most recent complaint names the town, all five current selectmen, three former selectmen, the town’s legal counsel, human resources director, a town meeting member, and the local firefighters union, and claims Alston's civil rights were violated, according to the Globe.

Alston had been on unpaid administrative leave for about three years when Brookline selectmen voted to fire him.
