Cape Cod Dentist Indicted After Nearly $200K In False Claims Submitted

A Cape Cod dentist submitted claims for work that was never performed, and that was performed by someone other than a licensed dentist.

FALMOUTH, MA — A Falmouth dentist was indicted this week for submitting nearly $200,000 in false claims to MassHealth, Attorney General Andrea Joy Campbell announced.

According to officials, Dr. Marcus Swann, 49, of Falmouth, and his practice, Direct Pay Dental, also of Falmouth, are each charged with four counts of Medicaid False Claims and Larceny Over $1,200.

Swann, officials said, submitted false claims for services that weren't provided and for services that were required to be performed by a dentist but weren't.

“I am proud of the team’s continued efforts to protect the integrity of the MassHealth program and our taxpayer resources, all while ensuring our residents receive the highest quality healthcare, including dental care and services,” said AG Campbell. “My office will continue to hold accountable those that violate the requirements and provisions of MassHealth.”

The indictments allege that, from May 10, 2017 through August 24, 2022, Swann and Direct Pay Dental billed MassHealth for procedures that were performed by dental hygienists or dental assistants, including patient exams and crowns, even though those services are required to be performed by a licensed dentist.

The indictments also allege that, from May 10, 2017 through December 31, 2020, Swann and Direct Pay Dental billed MassHealth for dental services that were not provided.
