Falmouth SB Discuss Resolution of All Wind Turbine Litigation

Falmouth Select Board: Douglas C. Brown, Megan English Braga, Samuel H. Patterson, Susan L. Moran, Doug Jones, Town Manager and assistant-

Town of Falmouth, local residents are allowed a short period of time to make statements and ask questions in the Open Session of Select Board Meetings.

Usually, at 7 PM Public Comment is allowed in open session after the executive session unless of course that subject is listed on the agenda.

For the past few months, the Select Board has listed: "Discuss resolution of all turbine litigation," in executive session M.G.L. c.30A s.21(a)(3) on the agenda.

The end result of months of meetings is no one is allowed to ask questions or relay information at the Open Session about the wind turbines.

The listing of wind turbine litigation repeatedly on the agenda appears to be a tool to restrict information or comment from being made public or passed onto any third party or the news media.

The town has never posted the Vestas 110 decibel August 2010 warning letter and other associated documents. Be assured one question to the Select Board would be why not? Ultimately if the documents were posted in the beginning the turbines would never have been built.

The " Friends of Falmouth Wind " filed a "Motion to Intervene" on October 18, 2017, in wind turbine litigation that ended on June 20, 2017. The Falmouth Zoning Board has again hired an attorney to handle the "Motion to Intervene."

In July Select Board Chairwoman Susan Moran said: “It's time to put the matter behind us and move forward.”

Now with litigation being filed again with very little chance of the resolution to all wind turbine litigation. It's time to put all the cards on the table.

In order to move forward, the Falmouth Select Board has to post all the Falmouth wind turbine documents on the town website. The documents have to include all the documents including the Vestas warning letter, maps, memos, emails.

Falmouth residents have to be made aware of the "Project Regulatory Agreement" brokered between the Massachusetts Department of Environmental Protection and SRF, State Revolving Fund.

The Falmouth Zoning Board and Massachusetts Superior Court have seen all the documents. Why not the residents of Falmouth?

Falmouth Wind One is a 1.65 megawatt wind turbine owned by the Town of Falmouth, MA, USA, manufactured by Vestas, erected in 2010 and now in a permanent state of shut down for lack of zoning permitting and neighbor complaints.

Since this video was made both Falmouth wind turbines have been shut down by the Falmouth Zoning Board and the Massachusetts Superior Court.
