The Massachusetts Superior Court in 2017 ordered that the decision of the Falmouth Zoning Board of Appeals be affirmed that the operation of Wind # 1 and Wind # 2 constitute a nuisance and that the Town of Falmouth ceases and desists operation of the wind turbines. They have not operated since 2017.

A contractor has been hired to dismantle and/or demolish both town-owned megawatt wind turbines.

Falmouth Wind # 1 was demolished on September 26, 2022..
