Falmouth Wind Turbines The Long Con

Wind turbines a bunco scheme of enormous consequence. People should not be fleeced by government officials by an agenda taking health.

A long con is a scam that unfolds over years. It aims to rob the taxpayers of huge sums of money or valuable things like health and property rights.

The common factor is simply that the taxpayer relies on the good faith of the elected officials directed by legal professionals hired by the town.

The single biggest so-called "mistake" made by the town was hiding the Vestas of America warnings the turbines generate 110 decibels of noise raising noise levels to chest pounding levels in nearby neighborhoods. The town compounded the mistake by waiting until after the 2013 vote not to take down the wind turbines to release warning letters and emails. Understandably the turbines should have never been built but state officials were quoted as you have to break a few eggs to make an omelet meaning the neighbors.

Falmouth elected officials over the last eight years have established a record of telling Town Meeting Members the wind turbine lawsuits are a slam dunk and at each meeting say the lawsuits will be over by the end of the year. Town Meeting Members who meet every six months have been approving up to $300,000.00 every six months for more litigation.

This year is no different than any other year. The taxpayers have been told all the lawsuits will end this year 2018 again.

In June of 2018, the Town of Falmouth settled ten nuisance complaints with residents over the two wind turbines at the wastewater treatment plant. This was mediated by an outside law firm at taxpayer expense and the Massachusetts Interlocal Insurance Association. Only months later people are asking what constitutes an insurer's good faith when it settles some but not all of the lawsuits or claims against the insured.

Later in June of 2018 after the nuisance complaints were resolved, neighbors filed a complaint with the Building Commissioner to remove the wind turbines as after one year lack of operation constituted abandonment under Falmouth’s wind energy bylaw required removal. The Building Commissioner misfiled the complaint déjà vu.

The long con continues: The town has hired an engineering firm, again at taxpayer expense to remove Falmouth Wind I and find a new location for Falmouth Wind II. There will be no information available until January 2019.

The "Friends of Falmouth Wind" who by court definition have no standing and filed too late have filed litigation to intervene in a lawsuit that started years ago. The court hearing date in the Massachusetts Appeals Court is Tuesday, October 2, 2018.

The Massachusetts Appeals Court decision from the October 2, 2018 hearing results are generally decided by the end of three to four months. Coincidentally the findings by the court will come out the same time the town has information on the engineering firm taking down and/or moving the turbines.

Unbeknown to the public the Town of Falmouth has been corresponding with the Massachusetts Clean Water Trust for over a year over Falmouth Wind II. The Massachusetts Department of Environmental Protection brokered a Project Regulatory Agreement between the Town of Falmouth and Massachusetts Clean Water Trust for the loan/grant. Where the heck is this correspondence on the town website or being dicussed with Town Meeting?

The Town of Falmouth wanted to know from the MCWT if the turbine commenced operation again, would this meet the terms and conditions to receive loan forgiveness under Project Regulatory Agreement? The Massachusetts Clean Water Trust committee was unable to determine if this would be possible without more information about the sale and eventual operation of Wind 2.

Commercial wind turbines are a bunco scheme of enormous consequence. The people who value intellectual honesty should not quietly be fleeced by such mendacity, even from their elected government officials
