Inept MassDEP To Get Appeal From Ocean Wind Company
MassDEP Brokered Project Regulatory Agreement ("PRA") Loan Agreement On Falmouth Wind Turbine Result: Ten Years of Litigation Torture

The ocean wind turbine company whose permit was denied by a Marthas Vineyard Conservation Commission is planning to request a “superseding order” from the state Department of Environmental Protection.
There is no doubt corruption and incompetence continues unabated on Beacon Hill until further notice which will include a “superseding order” from MassDEP yet again like Falmouth ignoring health, property rights and livelihood of Massachusetts citizens.
The bottom line here is the Massachusetts public has lost all trust in the Massachusetts Department of Environmental Protection and Attorney General Maura Healey who is the chief lawyer and law enforcement officer of the Commonwealth of Massachusetts and possible future candidate for Governor.

Prior to the installation of the second horrific Vestas megawatt land-based wind turbine MassDEP brokered a power production loan agreement between the Massachusetts Clean Water Trust and Town of Falmouth using State Revolving Funds. This agreement ignored state noise regulations leading the MassDEP to become an inept state agency along with the Attorney General who left Falmouth citizens and 21 other towns to hire law firms to protect their health and property rights.
Falmouth "Wind II" was funded with amounts of money provided through the American Recovery and Reinvestment Act of 2009 ("ARRA") provided by the PRA agreement brokered by MassDEP. Health and property rights are still being ignored today.

American Recovery Reinvestment Act of 2009 stimulus funds cannot be used if a substantial and specific danger to public health or safety yet the Massachusetts Department of Environmental Protection and Attorney General Maura Healey allowed federal funds to be used again to rebuild Falmouth Wind II in a new location despite a written warning from Vestas wind company:
"The Town (Falmouth) has previously been provided (prior to construction) with the Octave Band Data / Sound performance for the V82 turbine. This shows that the turbine normally operates at 103.2dB but the manufacturer has also stated that it may produce up to 110dB under certain circumstances."
MassDEP no longer ensures clean air, land, and water. The commercial wind turbine business and the Massachusetts Department of Environmental Protection has become an inept agency and a bunco scheme of enormous health and finance consequence.
The citizens who value intellectual honesty should not quietly be fleeced by such mendacity, even from their government.
