Charles Baker, Jr., has been serving as the 72nd governor of Massachusetts since January 8, 2015.

Outside legal counsel hired by the state of Massachusetts in 2013 has advised that Wind II (Falmouth wind turbine #2) is subject to specific provisions of ARRA and applicable federal regulations and guidelines ("Federal Law') in addition to the terms and conditions of the Project Regulatory Agreement ("PRA") and the Loan Agreement brokered by MassDEP associated with the funding of Wind II.

Under Federal Law and the 5 million PRA and Loan Agreement, the Town must maintain Wind II as an "energy efficiency" project, as described in EPA guidelines dated March 2, 2009, or pay back the loan plus 2 percent interest.

The turbines have not been energy efficient for three years since the courts shut down the nuisance wind turbines. The American Recovery and Reinvestment Act funds from 2009 should never have been loaned to the Town of Falmouth. The danger was known prior to construction the turbines emit 110 decibels of noise each affecting up to 200 residential homes.

The Massachusetts Executive Office of Energy and Environmental Affairs, EEA, manages and preserves the Commonwealth's open spaces, enforce pollution laws, ensures new development projects don't harm the environment and promotes eco-friendly energy production and conservation. The EOEEA under Governor Charlie Baker is the only state Cabinet-level office in the country that oversees six environmental and energy agencies.

The Massachusetts Department of Environmental Protection (DEP) is under the management of the EOEEA. MassDEP is stuck in regulatory capture working with the wind turbine industry ignoring the health and property rights of residential homeowners.

The Massachusetts Department of Environmental Protection acted as a broker financing the loan on the second town-owned Falmouth wind turbine known as Falmouth Wind II.

The Massachusetts courts shut down both town-owned wind turbines in June of 2017 but remain standing in violation of Falmouth zoning regulations. The loan is due leaving the state revolving fund short of renewable energy funds that could go out to more worthwhile energy projects. The town is being rewarded by Governor Baker allowing the town to use the ARRA funds to operate day to day operations.

Governor Charlie Baker, Lt. Governor Karyn Polito aka the Baker-Polito Administration is in charge of the ongoing wind turbine fiasco in Massachusetts and the 3.5 million dollars plus interest owed to the state revolving fund.

Governor Charlie Baker is allowing the Town of Falmouth to use 3.5 million in American Recovery and Reinvestment Act funds to run the day to day operations of the Town of Falmouth. The ARRA funds were used to endanger public health & safety through a loan brokered by MassDEP under the direction of the executive branch of government.
