Falmouth Used Federal American Recovery and Reinvestment Act Funds Despite Substantial and Specific Danger to Public Health or Safety.

Massachusetts Senator Elizabeth Warren spends weeks talking about cleaning up corruption in Washington. Warren has introduced three sets of legislation:Accountable Capitalism Act, Anti-Corruption and Public Integrity Act, and the American Housing and Economic Mobility Act represent Warren’s core issues?

What about the corruption using American Recovery and Reinvestment Act Funds to build commercial megawatt wind turbines taking health and property rights?

The sirens of corruption can be heard in Falmouth but Senator Warren who took office in 2013 cannot hear residents horrified and dismayed to learn that the Commonwealth of Massachusetts could simply ignore the health and safety of local residents over wind turbine noise.

In 2005 the Town of Falmouth had a wind study done by KEMA Inc and a map that showed General Electric a domestic wind turbine company installation would raise noise levels over state noise regulations. The study also stated a Special Permit is required to install one GE megawatt wind turbine. GE refused to place a single wind turbine in Falmouth because of residential setbacks and ice throw.

The Town of Falmouth then went forward filing an EPA waiver as required by federal regulations to buy a foreign made Vestas wind turbine: Environmental Protection Agency (EPA). ACTION: Notice. American Recovery and Reinvestment Act funds are to put Americans to work and require American products otherwise an EPA waiver is required to buy foreign as long as there is no substantial and specific danger to public health or safety.

In the EPA waiver the town left out the fact GE a domestic wind company refused to place a turbine, the Special Permit required and Vestas wind company had warned the turbines to generate 110 decibels each.

Each Vestas wind turbine generates 110 decibels each twice as loud as the General Electric turbine in the 2005 Falmouth KEMA Inc report.

The foreign made Vestas V-82 type 1.65 megawatt wind turbines were installed between 2010 and 2012 using 5 million in ARRA funds.

The Massachusetts Department of Environmental Protection brokered a Project Regulatory Agreement between the Town of Falmouth and the Massachusetts Clean Water Trust.

The Project Regulatory Agreement states the Town of Falmouth will keep Falmouth Wind II the second Falmouth wind turbine as an energy efficient project aka a power production agreement.

Federal American Recovery and Reinvestment Act funds are located in the Massachusetts State Reserve Fund where the Massachusetts Clean Water Trust gave the funds as a loan/grant to the Town of Falmouth.

As long as the turbine remained operational according to the state Project Regulatory Agreement the money remained a grant. This is the main reason state and local officials disregarded noise complaints from up to 200 residential home owners from the chest pounding turbines.

The courts shut down both Falmouth Wind I & II in June of 2017 as the turbines are a nuisance.

The loan/grant has never sufficiently been explained to the public. Most taxpayers were led to believe the 5 million in ARRA funds were free.

State and local officials were well aware the turbines generated 110 decibels of noise and never filed a Special Permit as stated in the EPA waiver. The result is gross mismanagement by state agencies and a waste of covered ARRA funds as they represent a substantial and specific danger to public health or safety related to the implementation or use of covered funds.

The Falmouth 2005 KEMA Inc study showed beyond a reasonable doubt even one Vestas V-82 turbine or any other turbine would break state noise regulations.

This KEMA study showed in advance of the wind installations laws, rules and regulations would be broken regarding the use of American Recovery and Reinvestment Act funds.

Massachusetts Senator Elizabeth Warren granted took office in 2013 and the turbines were shut down in 2017 but where has Elizabeth Warren been on looking into how the federal American Recovery and Reinvestment Act funds were used to take the health and property rights of the folks in Falmouth.

For years state and local officials said anyone who complained about the torturous wind turbine noise was a NIMBY.

Now with the corruption over the use of federal funds Senator Elizabeth Warren as far as corruption goes is Not In My Back Yard.Massachusetts
