Driver In Crash That Killed Hingham Teen Indicted

David P. Oxner faces several charges including motor vehicle homicide and assault and battery with a dangerous weapon.

WEYMOUTH, MA — The driver in a crash that resulted in the death of a 19-year-old Hingham teenager will face charges in superior court, according to court documents.

A grand jury handed down the indictment against David P. Oxner Dec. 5. He faces several charges including motor vehicle homicide, assault and battery with a dangerous weapon, and a marked lanes violation, according to court documents from Norfolk Superior Court in Dedham.

The indictment moves the case from Quincy District Court to the higher court. An arraignment date has not been set.

On Aug. 10, police responded to a report of a crash at Union Point. Police say 19-year-old Samuel Gates was riding a motorcycle with his girlfriend when his bike was struck by an SUV driven by Oxner. Both vehicles caught on fire and Gates was pronounced dead at the scene. His girlfriend was transported to Massachusetts General Hospital with serious injuries.

At the time of his death, Gates was entering his sophomore year of college at UMass Boston.

Oxner was not injured. His license has been suspended while the motor vehicle homicide charge remains pending.
