Entwistle Appeal Questions Legality of Searches

Although it has been four years since Neil Entwistle was convicted of killing his wife and daughter in their Hopkinton Home, the appeals process is still continuing.

Today the Massachusetts Supreme Judicial Court heard arguements from Entwistle's appeals lawyer saying that the search conducted by the Hopkinton Police Department was not legal.

Hopkinton police searched the house twice at the request of family members. The first search turned up nothing but during the second sweep the bodies were discovered under blankets on a bed.

According to the Boston Globe, Entwistle's attorney Stephen Paul Maidman said that the police did not have probable cause to search the house the second time.

"Maidman said police needed to get a search warrant before they entered the home the second time. 'Police should have obtained a search warrant,’' he said of the second search. 'They could have tried.'"

According to the article Maidman also questioned the jurors, people he says were not impartial.
