Man Charged with Selling Fentynal as Heroin Out of Mansfield Motel Room

MANSFIELD, MA — A former Taunton man currently residing in a sober home in New Bedford was selling fentanyl advertised as heroin out of a Mansfield hotel, police said.
Dan H. Smith, 34, was ordered held without bail during his arraignment Thursday in Attleboro District Court, according to the Sun Chronicle. The decision came because he is wanted by federal and state department officials. On the new charges, he was ordered held on $30,000 cash bail.

Smith was arrested Wednesday morning at the Red Roof Inn on Forbes Boulevard. He was charged with possession of fentanyl, possession of fentanyl to distribute (subsequent offense), drug conspiracy and possession of crack cocaine. Assistant District Attorney Mary Elizabeth Mack said officers spoke with people who said Smith sold heroin from the room to a woman.
During a search, police allegedly found 5 grams of crack cocaine and over 2 grams of a brown powder later identified as fentanyl.

Defense lawyer Richard Silva questioned the witness' statement and legality of the search.
Smith is due back in court on Oct. 17.
