Update on Pipeline Intervenor Process

The following information was submitted by North Reading Selectman Jeff Yull.

To the property owners of North Reading:

This is a reminder to those who wish to be an intervenor. December 31st is the final day to apply
however, you may ‘Motion to Intervene Out of Time’. To become an intervenor or ‘Motion To Intervene Out of time’ go the Town of North Reading Website: www.northreadingma.gov, type FERC in
the search bar, select ‘Sel. Yull Letter re Intervenors’, then select the link to FERC within the letter, or
you may go directly to the FERC website using link: http://www.ferc.gov/resources/guides/how- to/intervene.asp. Upon completing your submittal you will receive confirmation with a number assigned to your submission and an email confirmation from FERC.

A key purpose of the intervention deadline is to determine, early on, who the interested parties are and what information and arguments they can bring to bear. Interested parties are not entitled to hold back awaiting the outcome of the proceeding, or to intervene when events take a turn not to their liking.

The Commission’s regulations dealing with motions for late intervention state that, in acting on such a motion, the decisional authority may consider:

  • Whether the movants had good cause for not filing timely;
  • Any disruption of the proceeding that might result from permitting intervention;
  • Whether the movant’s interest is adequately represented by other parties; and
  • Whether any prejudice to, or additional burden on, existing parties might result from permitting intervention.

Late intervention at the early stages of a proceeding generally does not disrupt the proceeding or prejudice the interest of any party. The Commission is therefore more liberal in granting late intervention at the early stages of a proceeding. A petitioner for late intervention, however, bears a higher burden to show good cause for late intervention after the issuance of a final order in a proceeding and generally it is Commission policy to deny late intervention at the rehearing stage, even when the movant claims that the decision established a broad policy of general application.

As most of you probably know Kinder Morgan, Inc. through its subsidiary Tennessee Gas Pipeline L.L.C., plans to construct a natural gas pipeline referred to as the Northeast Energy Direct Project or NED. This is an interstate project that has local, national and international implications. The local area of concern is the Lynnfield Lateral portion of the pipeline which runs through North Reading. The purpose of the lateral is to connect to an established pipeline in Lynnfield for further distribution. Although the Tennessee Pipeline will follow alongside the electrical grid, in North Reading it will also run through 42 properties of which 30 are private homeowners, and businesses, with the remaining 12 being town own land.
