Man Who Stabbed Waitress In Neck Heads Back To MA: Prosecutors

Gerardo Menjivar will face an attempted murder charge for allegedly stabbing her in the neck when she confronted him about a skipped bill.

CHELSEA, MA — The man accused of stabbing a Chelsea waitress in the neck after ditching on his dinner tab will face and attempted murder charge in Massachusetts. Gerardo Menjivar, 36, was taken into custody Wednesday by the Suffolk County District Attorney's Special Investigations Unit. Menjivar has been in Prince George's County, Maryland, since he was arrested there earlier this month.

Menjivar is expected to appear Thursday in Chelsea District Court on charmed of armed assault with intent to murder and assault and battery with a dangerous weapon, the DA's Office said.

Menjivar, who most recent address was in Lynn, allegedly left Las Pupusas Del Chino restaurant around 11 p.m. on May 7 without paying his bill. When the waitress confronted him on Blossom Street, he allegedly stabbed her in the throat. The victim was transported to Mass General. She is expected to survive.

Chelsea Police identified her attacker as Menjivar and obtained a warrant for his arrest. He was arrested May 10 in Beltsville, Maryland, and waived extradition proceedings the next day.
