Westford Advisory: Retail Capacity Limit At 25 Percent For Alcohol Sales, Too
All licensees must ensure that they comply with Massachusetts retail capacity of 25 percent for sales of alcoholic beverages.

On Jan. 7, 2021, Governor Charlie Baker issued an Order extending the time period on the
restriction on the number of patrons allowed in retail licensees’ premises to 25% capacity limit.

This includes licensees that sell alcohol for consumption both on- and off-premises. A summary

As the Governor ordered on Dec. 22, all retail licensees are restricted to a 25% capacity
limit. This applies to indoor and outdoor seating separately.

For off-premise licensees, the 25% capacity limit is calculated by the occupancy load as stated on
a licensee’s certificate of inspection issued under the State Building Code.
For on-premise licensees, the 25% capacity limit is based on a licensee’s seating capacity.
Questions regarding seating capacity should be directed to your local licensing authority.
Workers/staff are excluded from the occupancy count.
These limits are now in effect until Jan. 24, unless further extended by the Governor.
