Weymouth Man Suing Duxbury for Cremating Sister

A Weymouth man and his brother allege that the town of Duxbury mistakenly cremated their sister in 2013.

A Weymouth man and his brother are suing the Town of Duxbury for mistakenly cremating their sister, who wanted to be buried in a cemetery.

The brothers, Richard Marsh of Weymouth and William Marsh of Bourne, are suing the town for “interference with human remains, and negligent and intentional infliction of emotional distress,” according to the Boston Globe.

According to court documents, their sister, Frances Hickey, was in the chief medical examiner’s office in Boston for 18 days after she died in 2013. After the body of a man with the same last name arrived at the facility, Frances Hickey’s body was taken and delivered to Duxbury’s municipal cemetery

Arthur Kreiger, town counsel for Duxbury says the town did nothing wrong and followed normal procedures, placing fault on other parties.
