Officials said Nevills was living in the apartment complex with the boy's mother. He told officials he was sitting on a couch in the apartment and put his Glock 22 between a seat cushion and the armrest, according to reports, citing court documents.

Nevills then told officials he was high on marijuana and "zoned out" while scrolling through his phone, according to reports citing court documents.
