Dearborn Man Will Not Face Charges In Gas Station Shooting: Prosecutor

DETROIT — A Detroit gas station clerk will not face charges in connection with a Saturday shooting that killed a 17-year-old boy from Detroit, according to the Wayne County Prosecutor's Office.

Prosecutors said the 28-year-old clerk from Dearborn acted in self-defense inside the Citgo gas station at 9126 Dearborn Street at 1 a.m. when he shot 17-year-old Yaqoub Nagi multiple times.

Officers found Nagi laying on the ground behind the door to the front counter of the gas station shot dead with multiple gunshot wounds in his upper body, prosecutors said.

The clerk remained at the gas station and was detained in connection to the shooting, prosecutors said.

While reviewing evidence, investigators determined Nagi walked into the gas station and went behind the clerk's counter where the employee confronted him, prosecutors said.

The clerk then saw Nagi "holding an object with his hands together pointing as if he had a handgun," prosecutors said.

That's when the clerk opened fire, shooting off multiple rounds that fatally wounded Nagi, prosecutors said.

Investigators determined the clerk acted in self-defense. Under Michigan law an individual who is not engaged in committing a crime may use deadly force against another anywhere he/she has a legal right to be with no duty to retreat, according to the prosecutor's office.

The individual must honestly and reasonably believe that the use of deadly force is necessary to prevent imminent death or great bodily harm to himself or herself, or to another individual, according to the prosecutor's office.

"Last summer, there were a series of shootings at Detroit gas stations - some of them resulted in a loss of life," Wayne County Prosecutor Kym Worthy said. "This case is yet another deadly shooting in a gas station, but the facts are very different. The evidence in this case shows that the actions of the store clerk were in lawful self-defense and as a result this office will not be charging him with any crime."

Officials did not identify the gas station clerk because he was not charged with a crime, according to the prosecutor's office.
