Open Burning: Is it legal? What are the requirements?
Open burning is legal in Hartland and Deerfield townships, but here are rules that must be followed.

October is fire prevention month and I would like to remind everyone about the responsibilities associated with the open burning of yard waste and leaves. Open burning is allowed in Hartland and Deerfield townships. However, the following guidelines shall be followed:
- Not allowed during windy conditions.
- Must be during daylight hours only.
- Must be 50 feet away from any structure.
- Must be located in a clear area (ground and above).
- Must be attended at all times by a responsible adult.
- Pile must be no larger that 3 feet high by 5 feet in diameter.
- Smoke must not infringe on your neighbors.
- Must call 810-632-7676 before burning.
You may burn
- Un-treated wood
- Brush
- Leaves
- Paper/Cardboard
You may not burn
- Tires, Plastics, Wood containing glues (Plywood, Particle Board, etc.)
- Treated Wood
- Oil or Accelerants (Gas, Kerosene, Diesel, etc.)
So, what does all of that mean? First, call to check on the open burning conditions. It is free and only takes minutes. If you have yard waste to burn, call 810-632-7676 to see if it is OK to burn at that time. If nobody answers the phone just listen to the voicemail, it will tell you if it is OK or not.
If it grows out of the ground, you may burn it, and WATCH THE WIND. If the wind is 10 miles per hour or greater, consider waiting until the wind dies down. If you start a fire, stay with it at all times, and make sure that it is completely out before leaving it. If the wind or conditions change, it is up to YOU to extinguish the fire. You are responsible for the fire and any damage it may cause. Watch your smoke and where it is blowing.

Smoke can be bothersome to neighbors and can cause adverse affects with certain health conditions. If your smoke bothers someone, be courteous and wait until the wind changes direction. If the fire department is called out due to your smoke obstructing a roadway, or being of a nuisance, you will be asked to extinguish it. If it becomes a repeated problem, you could face charges under the cost recovery ordinance. Also, DO NOT BURN DEBRIS IN A ROAD OR RIGHT OF WAY!
Finally, make sure that you can control your fire at all times. We are fortunate to live in an area that still allows open burning, and should be considered a very useful privilege.
