Woman Sentenced For Shooting Fast-Food Restaurant Over Missing Bacon

A Michigan woman who fired her 9mm handgun through a McDonald’s drive-up window after twice failing to get bacon on her burgers was sentenced to up to seven years in prison Tuesday.

Kent County Circuit Court Judge Paul Sullivan sentenced Shaneka Torres, 30, to one to five years for shooting at a building and another two years for possessing a firearm during the commission of a felony, MLive.com reports. The judge also said Torres must stay away from McDonald’s restaurants in the future.

Because Torres’ attorney is appealing the conviction, she was ordered held in the Kent County Jail, rather than sent immediately to prison, WOOD-TV reports.

A McDonald’s employee testified during Torres’ two-day trial last month that if she had been at her usual station during the early morning hours of Feb. 9, 2014, the bullet would have struck her in the head. No one was injured, but the building did sustain about $1,500 damage – which Torres was ordered to pay – and a bullet from her gun did enter the restaurant.

According to police reports and trial testimony cited in the MLive.com report, Torres rode to the restaurant with a friend to pick up a free replacement meal. She had complained to the restaurant several hours earlier that someone failed to add bacon to her burger, and the staff offered to make it good with a free meal.

When Torres discovered the same mistake had been repeated a second time, she reportedly said, “B----, you don’t know who you’re talking to,” and then fired the gun, the driver of the vehicle testified at trial.

Defense attorney John Beason told the jury the charges resulted from a misunderstanding, and Torres wasn’t mad about the bacon.

“Stupid? Yes. Mistake? Yes. Accident? Yes. Intentional? No,” Beason said. “She says she pulled the trigger, but she did not pull it on purpose.”

Unless her conviction is overturned on appeal, Torres must spend a minimum of two years in prison, the judge said at her sentencing Tuesday. It will be up to the Michigan Department of Corrections to figure out whether and how to impose and enforce the McDonald’s ban once she’s released.

Torres said Tuesday she was sorry and wishes she could have a do-over.

“But it’s over and done with,” she said, according to MLive.com.
