Camp Counselor's Statements in Federal Porn Case May be Tossed

Lawyer says recording shows FBI "ignored" Matthew Kuppe's request for lawyer during interrogation.

WEST BLOOMFIELD TOWNSHIP, MI – The former Jewish Community Center camp counselor facing federal pornography charges for allegedly posting nude pictures of children on a Russian website wants statements made to investigators suppressed at his trial.

The Detroit News reports that defense attorney Walter Piszczatowski argued in a motion filed in U.S. District Court,that Matthew Kuppe, 21, of West Bloomfield, did not knowingly waive his Miranda rights when he was interrogated by the FBI and then arrested last August.

Piszczatowski said a recording reveals that Kuppe said he wanted a lawyer, but authorities “ignored” the request proceeded with the interrogation “as if the words were never spoken.”

Kuppe, who was released from federal custody just before Thanksgiving, allegedly took nine sexually explicit photos of a 5-year-old in the camp locker room with his cellphone, them posted them on a Russian website.

Piszczatowski also seeks the dismissal of four of the six charges, which include production and distribution of child pornography, and wants to suppress evidence he said was improperly obtained from Kuppe’s email accounts.

Kuppe’s trial in U.S. District Court is scheduled to begin April 4. Earlier, the Detroit Free Press reported plea deal is in the works.

If convicted of the charges he currently faces, Kuppe could be sentenced to up to 20 years in prison.
