Bullying Prohibition Policy 514
“Bullying” means intimidating, threatening, abusive, or harming conduct that is objectively offensive and:
1. an actual or perceived imbalance of power exists between the student engaging in the prohibited conduct and the target of the prohibited conduct, and the conduct is repeated or forms a pattern; or
2. materially and substantially interferes with a student’s educational opportunities or performance or ability to participate in school functions or activities or receive school benefits, services, or privileges. Any person who believes he or she has been the victim of bullying or any person with knowledge or belief of conduct that may constitute bullying will report the alleged acts immediately to the building principal, site leader or the his or her designee.
Within three days of receipt of a complaint or report of bullying, the school district will undertake or authorize an investigation by school district officials. The school district is not authorized to disclose to a victim private educational or personnel data regarding an alleged perpetrator who is a student, contractor, volunteer, or employee of the school district.
Harassment Policy 548
In compliance with M.S. 121A.03, subd. 2 – Sexual, Religious, and Racial Harassment and Violence and M.S. 363A – Department of Human Rights, the District prohibits any form of harassment or violence on the basis of race, color, creed, religion, national origin, sex, marital status, familial status, status with regard to public assistance, sexual orientation, or disability.
It will be a violation of Policy 548 – Harassment and Violence for any student, employee, or agent of the District to harass a student, employee, or agent of the District on any of the bases listed in Section I of this Policy through conduct or communication defined by Procedures 548 – Harassment and Violence.
It will also be a violation of Policy 548 – Harassment and Violence for any student, employee, or agent of the District to inflict, threaten to inflict, or attempt to inflict violence upon any student, employee, or agent of the District on any of the bases listed in Section I of this Policy.
