Minnesota Moves To Let Seniors Drink Alcohol In Nursing Homes

A bipartisan bill would allow alcohol in nursing homes and assisted living, with restrictions and no sales.

ST. PAUL, MN — Minnesota lawmakers have approved a bill that would allow seniors to drink alcohol in assisted living facilities and nursing homes, a change supporters say is about dignity, independence, and quality of life.

The legislation (HF2027) passed the Minnesota Senate Tuesday on a 56-10 vote after clearing the House a day earlier and now heads to the governor’s desk.

If signed into law, the bill would allow facilities to permit alcohol without needing a liquor license, but with clear limits.

Alcohol could not be sold, and use would be restricted to residents and their guests, typically at events or gatherings inside the facility.

Supporters say the change reflects a simple idea: growing older shouldn’t mean losing everyday freedoms.

“This commonsense change cuts unnecessary red tape and ensures seniors can safely share a toast with friends and family in the place they call home,” said Matt Klein, a DFL lawmaker from Mendota Heights who sponsored the bill.

Under the proposal, facilities that choose to allow alcohol would need to notify the state and follow safety rules. Guests would have to be accompanied by residents, and alcohol service would be limited to activities primarily for residents.

Facilities would also remain subject to inspections and enforcement, including penalties for violations such as serving someone who is obviously intoxicated or allowing underage access.

The bill does not require any facility to allow alcohol, leaving the decision up to individual operators.

The broader measure includes a wide range of liquor-related changes, including special licenses for venues across Minnesota, from theaters and museums to universities and event spaces.

If signed by the governor, the new rules would mark a shift in how Minnesota regulates alcohol in senior living settings, giving facilities more flexibility while keeping guardrails in place.
