Stillwater Woman Charged With DWI Had .20 BAC: Police

A Stillwater woman is facing a DWI charge after a parent called the police to report underage drinking, the criminal complaint states.

WASHINGTON COUNTY, MN — A Stillwater woman is facing a DWI and a possession charge this week after a concerned parent called the police on her minor daughter and other minors said to be drinking last year.

The woman made her first court appearance this week, according to the Washington County Attorney's Office.

On July 30, 2016 at about 2:30 a.m., police were dispatched to the 2100 block of Helena Avenue in Oakdale on a report of underage drinking. The complainant said the minors who had been drinking had fled the residence and were driving in a silver and white vehicle.

The complainant indicated her minor daughter was one of the people involved in the drinking and was in the car. When the officer arrived, he observed the vehicle driving down 22nd Street South of the residence. The officer observed the driver was continually applying the brakes. When the officer caught up to the vehicle it had stopped.

The officer then approached the vehicle and made contact with the driver who was identified as Ashley Dawn Benert, then age 20, according to the criminal complaint. The police officer reported he could smell the odor of alcohol on her breath and had her perform some field sobriety tests. Authorities said these tests gave the indication of intoxication and the defendant was placed under arrest and transported to Washington County Jail.

During the booking process, the defendant had a Ziploc baggie in her purse that contained crushed amphetamine, according to police.

After being read her Minnesota Implied Consent Advisory the defendant agreed to give a breath test, according to the criminal complaint. Authorities said the test was administered at 4:28 a.m. and registered a .20 alcohol content.
