Capes Sokol Attorneys Save Missouri Client More Than $2.7 Million in U.S. Tax Court Case

Tax Court Orders IRS to Pay Taxpayer's Attorney's Fees

JANUARY 22, 2015, St. Louis, Missouri…In a case where the Internal Revenue Service alleged that the Petitioners, a trucking company and its sole shareholder, were liable for millions of dollars in corporate and gift tax deficiencies, penalties, and interest, the U.S. Tax Court found one hundred percent in favor of the Petitioners after a trial.

The case concluded on January 15, 2015, when the U.S. Tax Court entered its decisions and awarded attorney’s fees to one of the Petitioners. The Commissioner of Internal Revenue may appeal the decision.

The trial and post-trial briefing were handled by Capes Sokol attorneys Mark E. Goodman, Co-Chair of the Firm’s Litigation Practice, and Sara G. Neill, Chair of the Civil & Criminal Tax Controversy and Litigation Practice. Capes Sokol attorneys Laura Krebs Al-Shathir, David V. Capes and Michelle F. Schwerin also contributed substantially to the case.

“The Court’s opinion substantiates our view that this case should have never been pursued by the IRS in the first place. Neither the facts nor the law supported the government’s position. This is just another example of the IRS’s failure to use its limited resources wisely and fairly,” said Neill.
