Dan Boyle Prepares to Step into Judge Role

Unofficial results show Boyle as winner of low turnout special election.

Attorney Dan Boyle’s second run at the Florissant municipal court judge’s seat looks to be a successful one.

, according to the unofficial results from the St. Louis County Board of Elections.

“It was a lot of hard work,” Boyle said following his win. “I appreciate all of the efforts by the volunteers.”

Previously, Boyle challenged for the seat in the April election, and Kelly defeated Boyle, 4,976 votes to 4,196 votes.

In June, due to complications from his diabetes. He was 63.

After the Florissant City Council passed an ordinance for a special election of his seat, Boyle announced his candidacy for the seat as well as Tim Kelly’s brother, Kevin Kelly.

Kevin Kelly had hoped to succeed his brother in office as well as his father, who served as Florissant municipal court judge in the 1950s.

But Kelly fell short of that goal Tuesday night.

“I’m disappointed,” he said. “I thought we put up a good race.”

The low turnout of the election, less than 10 percent of registered voters came out, also might have played a role in the race.

With the election being so close in votes—47 votes differentiating them—the certified votes will give a better glimpse at how close it was. The certified votes will also tell whether a recount will occur.

Missouri statutes state that a recount can be done on an election when the difference of the vote is less than one percent; however, Kelly would have to initiate a petition for a recount. 

As of last night, it didn’t seem that either candidate thought too much about a recount.

“They have rules and whatever the rules are, if they apply, they’ll do the recount,” Kelly said. “Voters do the voting.”

“There were two recognized names competing for one spot,” Boyle said.

He continued to say that Wednesday, he’s looking ahead to moving forward.
