Brentwood Business President Sued by Business in Kansas City
In court documents, a Kansas City business alleges that Brentwood-based Food Service Equipment Distributors hasn't paid its bills.
David M. Brinkley, president of Brentwood-based , is being sued by Kansas City-based Fast Food Equipment Systems for breach of contract in the St. Louis County courtroom of Judge Barbara Wallace. Brinkley is a University City resident.
Fast Food Equipment owner Pat Phelan also owns The BSHL Group, the Midwest representative for numerous manufacturers, including Bakers Pride (pizza ovens, char broilers, etc.) and Brewmatic (coffee and tea brewers, etc.).
According to court documents, Fast Food Equipment says it entered into a contract agreement concerning the transfer of all commission sales related to manufacturers represented by The BSHL Group and territory distribution rights to all of Kansas, Nebraska, part of Iowa and part of Missouri for SaniServ (ice cream, yogurt, and shake machines) and Sharp commercial microwaves to Brinkley.
Fast Food Equipment further alleges Foodservice Equipment has only paid $44,326.50 of the agreed $155,383.94 and has also accrued penalty charges totalling $364,440.99.
Fast Food Equipment is seeking a judgment in the amount of $530,850.92 for the outstanding amount and penalties due on the contract.
A call placed to Phelan seeking comment was not returned while a call placed to Food Service Equipment seeking comment from Brinkley was answered by a message informing callers that the office number had been disconnected.
According to court documents, no appearance was made on behalf of Brinkley for a scheduled case management conference on Sept. 12 and Judge Wallace has continued the conference to Oct. 31.
