Donahue, Tucker & Ciandella (DTC) Attorneys no nothing about NH RSA 91-A (Right-to-Know Laws).

DTC Attorneys Eric Maher and William Waren recently filed a lawsuit on behalf of their client, the Town of Epping, NH, in Rockingham Superior Court, claiming RTK activist Jeffrey Thomas Clay violated NH RSA 91-A by filing RTK requests with Epping, proving they know nothing of Right-to-Know Laws (RTK).

The lawsuit filed by Maher and Warren is not only frivolous, vexations, wanton, and lacking any merit, its also malicious and abusive of the NH legal process.
Citizens are incapable of violating RTK. Moreover, Epping agreed to provide the requested records.

So, why did Maher and Warren file the lawsuit? I suspect it was filed to intimidate, defame, and abuse not only Mr. Clay but to send a message of intimidation to everyone who dares to exercise their rights to inspect public documents: you will be sued and dragged through the mud if you dare to file public records requests.

I suspect DTC Attorneys Ratigan and Matuszk are behind the filing of Epping’s lawsuit. These two attorneys are currently involved with Clay in RTK cases concerning Newmarket which are currently underway in Rockingham Superior Court.

Clay has filed criminal allegations against Ratigan and Matuszko with the NH Attorney General's Office concerning the Newmarket cases.

Epping will lose their lawsuit as it lacks any merit whatsoever and Attorneys Maher and Warren will get paid for his services. Unfortunately, however, Epping taxpayers will be footing the bill for a meritless lawsuit.
