FORMAL PUBLIC INTEGRITY COMPLAINT & REPORT OF OFFICIAL OPPRESSION

I. INTRODUCTION & JURISDICTIONAL STATEMENT

This formal complaint is submitted to the Public Integrity Unit to request a criminal investigation into former Newmarket Police Chief Gregory Jordan for acts committed under color of law that constitute Official Oppression (RSA 643:1) and a systemic failure to perform duties inherent in his oath of office.

This matter directly intersects with the boundaries established in Town of Newmarket v. Jeffrey Clay (Rockingham County Superior Court, Dockets 218-2023-CV-01356 and 218-2023-CV-01435). In those proceedings, the Superior Court explicitly ruled that no civil contract or settlement agreement can extinguish, waive, or impair a citizen’s right to report crimes to law enforcement, affirming that I "remain free to report [my] concerns to both the appropriate public enforcement agencies, which may elect to investigate."

Despite this clear legal baseline, Chief Jordan deployed the authority of his office to issue a summary, bad-faith refusal to investigate local municipal corruption, effectively weaponizing his position to insulate public officials from criminal exposure.

II. STATEMENT OF FACTS & SPECIFIC CRIMINAL CODE VIOLATIONS

The criminal nature of Chief Jordan’s misconduct is preserved in his official departmental response letter ("1000060121.jpg"). His actions satisfy the elements of several statutory violations:

1. Official Oppression (RSA 643:1) — Knowing Failure to Perform a Mandatory Duty

A public servant is guilty of a misdemeanor if, with a purpose to benefit himself or another or to harm another, he knowingly refrains from performing a duty imposed upon him by law or clearly inherent in the nature of his office.

  • The Act: Chief Jordan officially declined to open an investigation into documented municipal corruption because I asserted a conflict of interest involving him and requested he be bypassed in the reporting chain.
  • The Criminal Violation: Under NH law and police protocol, a reported conflict within a local agency requires immediate recusal and referral to an unconflicted outside agency (such as the County Attorney or State Police). Chief Jordan perverted this ethical mandate. He used the existence of his own conflict as a legal barrier to kill the complaint entirely, denying local police services and knowingly refraining from his mandatory statutory duty to detect and investigate crimes.
2. Causing a Public Servant to Rely on False Information & Misrepresentation (RSA 641:6)
  • The Act: Chief Jordan asserted in writing that "the matters you raise have previously been reviewed by competent investigators, attorneys, and members of the court system. Those reviews did not substantiate the claims you have presented."
  • The Criminal Violation: This statement is a fraudulent fabrication designed to create a false administrative record. The specific criminal allegations of felony fraud, unsworn falsification, and evidentiary tampering brought against town officials have never been investigated by any law enforcement body or criminal tribunal. Chief Jordan deliberately conflated civil administrative outcomes with criminal investigations to provide political cover for municipal actors.
3. Abdication of Statutory Jurisdiction & Unlawful Communication Moratorium
  • The Act: Chief Jordan closed his refusal by instructing me to "contact one of the investigative agencies within the State of New Hampshire" and declaring that his department "will take no further action... and will not engage in additional correspondence."
  • The Criminal Violation: A municipal police chief cannot unilaterally abdicate primary local jurisdiction over criminal code violations occurring within his geographic borders. Furthermore, issuing a blanket, preemptive ban on future communication with a citizen is an illegal maneuver explicitly designed to block ongoing statutory transparency rights under RSA 91-A and insulate his department from legal accountability.

III. THE UNDERLYING MUNICIPAL ENTERPRISE

Chief Jordan’s actions served to protect a broader, unauthorized municipal scheme. The settlement agreement the town relies on has never been authorized or ratified by the New Hampshire Legislature, purports to strip a citizen of constitutional rights, and violates RSA 91-A by utilizing illegal "rolling quorums" via private email dockets to conceal public records. The town's ongoing defense of this agreement relies on systematic violations of RSA 641, including felony-level false swearing and perjury (RSA 641:2) committed by town officials to deceive judicial officers. Chief Jordan's summary refusal was the vital mechanism used to keep this enterprise hidden from local criminal exposure.

IV. FORMAL INVESTIGATION DEMAND

Chief Gregory Jordan took a sworn oath to uphold the laws and constitution of the State of New Hampshire. His documented actions show that he instead used his office to obstruct justice, misrepresent official proceedings, and deny a citizen access to the criminal justice system.

I hereby demand that the Public Integrity Unit of the New Hampshire Attorney General’s Office open a formal investigation into former Chief Gregory Jordan for Official Oppression (RSA 643:1) and related public trust violations.
