Newmarket Town Council, Manager accused of Tampering Criminal Acts!

In a recent letter to the Rockingham County Prosecutor and NH Attorney General, I have accused members of the Newmarket Town Council and Town Manager of tampering with public records and falsifying physical evidence.

These public officials discussed, deliberated, and took action in violation of NH Right-to-Know Laws (RSA 91-A) and kept no record of their actions to conceal their actions from the public.

Under RSA 641:7, A person is guilty of a misdemeanor if he: “Purposely and unlawfully destroys, conceals, removes or otherwise impairs the verity or availability of any such thing.”

After a Right-to-Know complaint was filed against Newmarket officials with the Right-to-Know Ombudsman and AG’s Office, Newmarket committed additional crimes by falsifying physical evidence regarding their violations and by presenting false statements with a purpose to deceive the Ombudsman and Rockingham Superior Court.

Under NH RSA 641:6, A person commits a class B felony if, believing that an official proceeding, as defined in RSA 641:1, II, or investigation is pending or about to be instituted, he: I. Alters, destroys, conceals or removes any thing with a purpose to impair its verity or availability in such proceeding or investigation; or II. Makes, presents or uses any thing which he knows to be false with a purpose to deceive a public servant who is or may be engaged in such proceeding or investigation.

The NH Attorney General’s Memorandum on Right-to-Know Laws explicitly warns public bodies of the importance of keeping minutes which accurately record the proceedings before the public body and informs them of the consequences of RSA’a 641: 7 and 641: 6. Newmarket officials were aware of these laws and their consequences and chose to violate them anyway.

Newmarket’s Town Councilors involved in all of this include Katanna Conley, Scott Blackstone, Brian Ward, Joe LaMattina, Colin White Sr., Snoke Dornblut, and Justin Glazebrook. Newmarket Town Manager is Stephen Fournier.
